Commercial Contracts
When you agree to purchase from a supplier, you usually agree to accept their terms and conditions. When you agree to sell your goods or services to a customer, usually, you determine the terms and conditions.
For either type of transaction, purchase or sale, it is important you understand the obligations and/or liabilities you are agreeing to.
When purchasing, you seldom have the opportunity to vary any of the contract terms. You should, nevertheless, be fully aware of what you are accepting. In some circumstances it may be possible to negotiate terms but this will generally depend on your relative positions of strength commercially.
When selling, you have the opportunity, within the bounds of commercial reality and practicality, to impose your own terms to your own advantage.
